Aqd Al-Tamlik


Arabic (عقد التمليك) for contracts (aqd) that entails acquisition (or transfer) of ownership (mulkiyyah). This involves properties and rights (huquq) to benefit (from properties). The purpose of these contracts is to transfer ownership from one party (person) to another.

Aqd al-tamlik divides into three types, literally: aqd al-muawadhah (commutative contract), aqd al-tabarru (noncommutative contract), and noncommutative-cum-commutative contracts (aqd tabarru ibtidaan, muawadhah intihaanعقد تبرع ابتداءً معاوضة انتهاءً)
