Takhreej al-Manat


The process of coming up with a new ruling (hukm) for which there is presently no specific illah or effective cause available under a proper characterization (wasf). This involves establishing illah based on ijtihad. For example, takhreej is applied for the prohibition of riba that arises in the exchange of wheat or rice because it is makil (an element measurable by weight) of a genus or a food element of a genus (a category such as food items, or matoomat/edibles).

Takhreej al-manat, (تخريج المناط), (also spelled takhrij al-manat or takhreejul-manat) is a branch or part of ijtihad (reasoning as a source of shari’ah).

It is also known ijtihad qiyasi (analogy-based reasoning).
