Cooling-Off Option


An option (khiyar/ khayar) which gives one party or both parties to the contract (aqd) or a third party the right either to proceed with the contract or to revoke it within a specific period of time (as stipulated by the parties). The two parties understand that the contract is non-binding (aqd ghair lazim) and revocable during the term of the option.

This option (known in Arabic as خيار الشرط أو خيار فسخ العقد بالشرط) belongs to the broader category of options to reconsider (khiayrat al-tarawwi).
