Kafalah Mutlaqah


A mode of guarantee/ guaranty/ suretyship (kafalah) that is free from any condition whether in the form of deferment, acceleration, timing, etc. In this sense, the debt or the right to claim will be established according to the original state of establishment: the kafeel guarantees the same amount of debt for the same original description (due debt, deferred debt, etc). Thus, if the guaranteed debt is current (due) or deferred, the guarantee will also involve a current (due) or deferred debt.

Kafalah mutlaqah (كفالة مطلقة) is an Arabic term that translates as unrestricted guarantee/ unrestricted suretyship.
