Aqd al-Musaqah


A type of partnership contract (aqd al-musharakah) in which the owner of an orchard (bustan- in Arabic script: بستان) agrees to share a stipulated percentage of the produce of its trees with a worker (a’amilعامل), in exchange for the worker’s efforts of irrigation thereof. In this sense, it is a partnership between a capital provider (al-musaqiالمساقي) and a worker (al-saqi– الساقي), with the capital being the trees themselves, and the work being the irrigation and any related activities. The worker would receive compensation (ajr) in the form of the fruits produced by the trees subject matter of the irrigation contract.

Aqd al-musaqah is Arabic (عقد المساقاة) for contract of irrigation or more specifically fruit farming partnership.
