Arabic (هبة المجهول) for a gift (hibah) ) whose subject-matter (mahall) is unknown at the time it is made. Fuqaha were of different opinions as to permissibility (jawaz) of hibat al-majhul: Malikis considered it permissible even in cases involving donation of future inheritance and hibat al-ma’adoom (gift of nonexistent items/ things). Shafi’is, Hanbalis, and Hanafis bid to disagree, with varying degrees of rigidity.
Examples of hibat al-majhul is a gift of milk that is still in a cow’s udder (unmilked milk), and a gift of fetus that is still in an animal’s womb (unborn fetus).
