Tanqih al-Manat


The process of refining the basis of a ruling (hukm) by extracting the specific ruling from the text (nass) in which it co-exists with other rulings. By so doing, the ruling can be isolated or set apart in order to consider valid surrounding circumstances and disregard invalid ones. This involves the attachment of a ruling to an already established illah or effective cause. Therefore, a ruling can be extracted depending on the use of illah which doesn’t correspond thereto ab initio.

Tanqih al-manat, (تنقيح المناط), (also spelled tanqeeh al-manat or tanqihul manat) is a branch or part of ijtihad (reasoning).
