Variations in the rules of a transaction (safaqah) that result from the participation of multiple buyers or sellers or the involvement of a composite object of trade (such as an object of sale/ ba’i). The transaction may involve a combination of legal and illegal items or payment of a composite price (thaman) with part of it being paid using one type of countervalue (badal) and part of it using another.
Contracts which may be subject to tafarruq al-safaqah usually include contracts of sale (ba’i), contracts of lease (ijarah), contracts of plantation (muzara’ah), and so on. Certain schools of thought refer to the concept of tafarruq al-safaqah as tajazzu al-safaqah.
Tafarruq al-safaqah (تفرق الصفقة) is an Arabic term that translates as composite transaction or separated transaction or a transaction that can be bifurcated.
