Ahliyyat al-Wujub Al-Naqisah


Arabic (أهلية الوجوب الناقصة) for being partially eligible for taklif/ takleef, i.e., the capacity (ahliyyah) of a person to enjoy and exercise legal rights but without assuming responsibility (liability for rights exercised against him/ her). This applies only to the capacity to enjoy rights (ilzam) and does not include the ability to take up responsibility/ obligations (iltizam).

Partial legal capacity = enjoyment of rights

Rights enjoyed by birth include parentage, entitlement to inheritance and wills, etc.

Ahliyyat al-wujub al-naqisah is a subset of ahliyyat al-wujub.
